By applying, you are raising ESA\u2019s ability to connect ecologists with policymakers and to provide information to the media.<\/strong><\/p>\n<p>One of ESA\u2019s central missions is to share ecological information with policymakers and members of the media. Since the Society opened its Public Affairs Office in 1983, ESA has served as a trusted source of ecological information. The establishment of the RRT in 2005 enhanced our ability to respond to time-sensitive issues, such as 2010\u2019s BP oil spill and to the more recent Hurricanes Irma and Maria. ESA also encourages RRT members to alert the Society to policy issues or other opportunities.<\/p>\n<p><strong><a href=\"https:\/\/esa.org\/esablog\/ecology-in-the-news\/news-events\/call-for-new-esa-rapid-response-team-members\/\">Find more and how to apply here.<\/a><\/strong><\/p>\n<h2><strong>Action Alert: Ask your Members of Congress to restore funding for science<\/strong><\/h2>\n<p>Dear ESA Member:<\/p>\n<p>As you may know, President Trump\u2019s Fiscal Year 2020 (FY20) budget request sent to Congress would flat-fund or drastically cut scientific research accounts across many federal agencies. At the same time, lawmakers are working on a budget agreement to determine the overall level of federal spending.\u00a0<strong>ESA, along with other organizations in the scientific community, is urging congressional leaders to raise the budgetary caps for FY 2020 to avoid the effects of mandatory across-the-board cuts to agencies (sequestration) and to support funding for scientific research.<\/strong><\/p>\n<p>We\u00a0are hearing\u00a0from Hill staff that they are not receiving funding requests from individual scientist constituents. If you have reached out to your lawmaker: thank you! Say Thank You!<\/strong><\/p>\n<p>Thank your Member of Congress for their support\u00a0for\u00a0sustainable funding for our nation\u2019s science and technology agencies and ask them to continue sustainable, predictable funding and urge them to prioritize these investments and reject the administration-proposed cuts to science as they begin to craft the FY 2020 funding bills.<\/p>\n<h2><strong>Congress<\/strong><\/h2>\n<p><a id=\"Congress\"><\/a><br>\n<strong>Nominations<\/strong>:\u00a0<strong>The Senate voted to confirm David Bernhardt as Interior secretary.<\/strong>\u00a0All Senate Republicans, Sen. Joe Manchin (D-WV), Sen. Martin Heinrich (D-NM) and Sen. Kyrsten Sinema (D-AZ) voted for Bernhardt\u2019s confirmation. Bernhardt is a former oil, gas and water lobbyist who worked as Interior\u2019s Solicitor General during the Bush administration and served as deputy to former Interior Secretary Ryan Zinke.<\/p>\n<p>On Bernhardt\u2019s second day as Interior Secretary, the Interior Department\u2019s Inspector General\u00a0<a href=\"https:\/\/www.nytimes.com\/2019\/04\/15\/climate\/bernhardt-interior-department-ethics-investigation.html\">told<\/a>\u00a0lawmakers and watchdog groups that her office is launching a review of ethical complains against Bernhardt, including an allegation that Bernhardt blocked the release of scientific studies analyzing the impacts of certain pesticides on endangered species.<\/p>\n<p><strong>Legislative updates:<\/strong><\/p>\n<ul>\n<li><strong>President Trump signed\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/2030\">H.R. 2030<\/a>\u00a0authorizing the Interior Department and the U.S. Bureau of Reclamation to implement a drought contingency plan for the Colorado River basin.\u00a0<\/strong>All states in the Colorado River basin approved the plan in March 2019. Shortly after, California\u2019s Imperial Irrigation District, the largest single water user in the river basin,\u00a0<a href=\"https:\/\/www.desertsun.com\/story\/news\/environment\/2019\/04\/17\/iid-sues-halt-colorado-river-drought-plan-says-mwd-ignored-salton-sea\/3496955002\/\">sued<\/a>\u00a0to halt the plan in California state courts, claiming other California water districts violated state environmental laws when they agreed to the terms of the contingency plan.<\/li>\n<li><strong>Sen. Lisa Murkowski (R-AK), Sen. Dan Sullivan (R-AK) and Sen. Brian Schatz (D-HI) introduced the Arctic Policy Act\u00a0(<a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/senate-bill\/1179?q=%7B%22search%22%3A%5B%22s.+1179%22%5D%7D&amp;s=3&amp;r=1\">S.1179<\/a>),<\/strong>\u00a0which would add two additional indigenous representatives to the U.S. Arctic Research Commission to better incorporate traditional knowledge in arctic science.\u00a0It also permanently establishes the Arctic Executive Steering Committee and creates two advisory committees, comprised of tribal representatives and representatives of Arctic communities, to the Arctic Executive Steering Committee.<\/li>\n<li><strong>Senate Energy and Natural Resource Ranking Member Joe Manchin (D-WV) and four Senate Republicans introduced the Enhancing Fossil Fuel Energy Carbon Technology (EFFECT) Act\u00a0(<a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/senate-bill\/1201\/\">S. 1201<\/a>)<\/strong>, which would create carbon capture research programs in the Department of Energy.<\/li>\n<\/ul>\n<h2><strong>Executive Branch<\/strong><\/h2>\n<p><a id=\"execbranch\"><\/a><br>\n<strong>CASAC:\u00a0The EPA\u2019s Scientific Advisory Board Staff Office released a\u00a0<a href=\"https:\/\/yosemite.epa.gov\/sab\/sabproduct.nsf\/LookupWebProjectsRequestsforCommentsCASAC\/C1F67917564AD4D1852583900067FC7B?OpenDocument&amp;TableRow=2.1#2.\">list of nine candidates<\/a>\u00a0for the Clean Air Scientific Advisory Committee (CASAC).\u00a0<\/strong>The EPA is seeking an individual with expertise in ecology. Tim Lewis, a recently retired U.S. Army Corps of Engineers aquatic ecologist, announced earlier this year his intention to resign once a replacement is appointed. The seven-member CASAC provides outside scientific advice to the EPA\u00a0on the technical bases for the National Ambient Air Quality Standards.\u00a0Comments on the nominees are due April 30, 2019.<\/p>\n<p>On April 11, the CASAC sent EPA Administrator Andrew Wheeler a\u00a0<a href=\"https:\/\/yosemite.epa.gov\/sab\/sabproduct.nsf\/LookupWebReportsLastMonthCASAC\/6CBCBBC3025E13B4852583D90047B352\/%24File\/EPA-CASAC-19-002%20.pdf\">letter\u00a0<\/a>recommending that Wheeler reinstate the CASAC particulate matter panel, a subcommittee of 20 scientific experts because the committee lacks the scientific breadth of knowledge needed to adequately review the EPA\u2019s draft Integrated Science Assessment for Particulate Matter. Wheeler disbanded the particulate review panel in October 2018.<\/p>\n<p><strong>EPA:\u00a0A\u00a0<a href=\"https:\/\/www.epa.gov\/npdes\/interpretative-statement-releases-pollutants-point-sources-groundwater\">new legal interpretation<\/a>\u00a0states the Clean Water Act only regulates pollution discharges into surface water and does not cover discharges into groundwate<\/strong>r, even if the groundwater discharges will reach surface waters. In a\u00a0fact sheet, the EPA points out that other environmental laws such as the Safe Drinking Water Act, the Resource Conservation and Recovery Act and the Comprehensive Environmental Resources, Compensation and Liability Act apply to groundwater.\u00a0The Supreme Court will hear a lawsuit dealing with this issue,\u00a0<em>County of Maui, Hawaii v. Hawai\u2019I Wildlife Fund<\/em>, later this year. This interpretative statement applies to states outside of the Ninth Circuit Court of Appeals, which covers the west coast, Alaska and Hawaii and the Fourth Circuit Court of Appeals, which covers the east coast from Maryland to South Carolina.<\/p>\n<p><strong>NOAA<\/strong>:\u00a0<strong>The National Marine Fisheries Service\u00a0<a href=\"https:\/\/www.nola.com\/environment\/2019\/04\/feds-list-gulf-of-mexico-brydes-whales-as-endangered.html\">listed<\/a>\u00a0the Gulf of Mexico Bryde\u2019s whale as an endangered species,<\/strong>\u00a0starting May 15. Bryde\u2019s whales are the only baleen whales that live in the Gulf of Mexico year-round, and NOAA estimates that there are less than 100 individuals in this population. Oil and gas activities in the Gulf of Mexico, collisions with shipping vessels, anthropogenic noise and entanglement with fishing gear all threaten the population\u2019s survival.<\/p>\n<p><strong>NPS:\u00a0Acting Director P. Daniel Smith\u00a0<a href=\"https:\/\/www.nationalparkstraveler.org\/2019\/04\/updated-david-vela-once-nominated-be-national-park-service-director-tabbed-deputy-director\">promoted<\/a>\u00a0David Vela, Trump\u2019s nominee to lead the Park Service, to the position of the acting deputy director of operations in the agency\u2019s headquarters<\/strong>. The Senate Energy and Natural Resources advanced Vela\u2019s nomination in November 2018, but the full Senate did not confirm Vela in the 115<sup>th<\/sup>\u00a0Congress and the President has not yet re-nominated him in the 116<sup>th<\/sup>\u00a0Congress. Previously, Vela served as the superintendent of Grand Teton National Park. Watchdog group Public Employees for Environmental Responsibility filed a complaint with the Interior Department Inspector General claiming that this appointment is illegal because only a Senate-confirmed NPS director can appoint a deputy director for operations. NPS has not had a Senate-confirmed director since January 2017.<\/p>\n<p><strong>USFWS:\u00a0The agency\u00a0<a href=\"https:\/\/www.newsobserver.com\/news\/business\/article229179354.html\">initiated<\/a>\u00a0a new status review of the bi-state greater sage grouse distinct population segment to determine whether this population segment should be listed under the Endangered Species Act<\/strong>. USFWS originally proposed listing this population, which is found along the California-Nevada border, as a threatened species in 2013 and withdrew this proposed rule in 2015. In May 2018, a federal judge determined that USFWS acted in \u201carbitrary and capricious\u201d manner when it decided not to list the bi-state sage grouse. USFWS also re-opened the comment period on the original proposed rule listing the species as a threatened species and is\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2019\/04\/12\/2019-07252\/endangered-and-threatened-wildlife-and-plants-threatened-status-for-the-bi-state-distinct-population\">accepting public comments<\/a>\u00a0on that rule through June 11, 2019. A final determination will be released by Oct. 1, 2019.<\/p>\n<p><strong>USDA:<\/strong>\u00a0The Washington Post\u00a0<a href=\"https:\/\/www.washingtonpost.com\/science\/2019\/04\/19\/usda-orders-scientists-say-published-research-is-preliminary\/?utm_term=.b4391ec14d9c\">reports<\/a>\u00a0that a 2018 memo from the acting USDA chief scientist requires agency researchers to include a disclaimer that results published in scientific journals are \u201cpreliminary.\u201d<\/p>\n<h2><strong>States<\/strong><\/h2>\n<p><a id=\"states\"><\/a><br>\n<strong>WOTUS:\u00a0Attorneys Generals from 14 states and the District of Columbia\u00a0<a href=\"https:\/\/www.washingtonpost.com\/climate-environment\/2019\/04\/16\/fifteen-ags-slam-trump-move-limit-federal-authority-under-clean-water-act\/?utm_term=.cca89c2129c8&amp;wpisrc=nl_energy202&amp;wpmm=1\">submitted<\/a>\u00a0public comments opposing the EPA\u2019s proposal to redefine the water of the U.S.,<\/strong>\u00a0claiming that regulatory rollback is contrary to the goals of the Clean Water Act and violates the Administrative Procedures Act. Seventeen other state attorney generals, led by West Virginia Attorney General Patrick Morrisey (R),\u00a0<a href=\"https:\/\/mailchi.mp\/wvago\/wva-ag-17-states-support-plan-to-ease-burden-on-farmers-landowners\">submitted comments<\/a>\u00a0in support of the new definition.\u00a0<strong>ESA and 12 other scientific societies jointly\u00a0<a href=\"https:\/\/esa.org\/esa\/wp-content\/uploads\/2019\/04\/2019_4_10-Science-Societies-WOTUS-Letter-Final.pdf\">commented<\/a>\u00a0that the proposed rule \u201cis not based on sound science or the best-available peer-reviewed information.\u201d<\/strong><\/p>\n<p><strong>Oregon:\u00a0The state Department of Fish and Wildlife (ODFW)\u00a0<a href=\"https:\/\/www.oregonlive.com\/environment\/2019\/04\/state-releases-long-awaited-draft-management-plan-for-wolves.html\">released<\/a>\u00a0a\u00a0<a href=\"https:\/\/dfw.state.or.us\/Wolves\/docs\/oregon_wolf_program\/Draft_Wolf_Plan_4-12-19.pdf\">draft wolf management plan<\/a><\/strong>\u00a0for the eastern third of the state, after a five-year delay. The most significant change would allow ODFW to issue a permit to a rancher or their designee to kill a wolf if there are two confirmed livestock depredations in the area in the past nine months and ODFW determines that wolves present a significant risk to livestock present in the area. Currently, ODFW can authorize the killing of a wolf that has attacked livestock twice over any time period. This management plan does not apply to wolves in the western parts of the state where gray wolves are still listed under the federal Endangered Species Act. The Oregon Fish and Wildlife Commission will vote on the plan during its June 7 meeting. ODFW will allow public testimony on the plan during the meeting and is\u00a0<a href=\"https:\/\/dfw.state.or.us\/news\/2019\/04_Apr\/041519b.asp\">accepting written testimony<\/a>\u00a0through May 23.<\/p>\n<h2><strong>International<\/strong><\/h2>\n<p><a id=\"international\"><\/a><br>\n<strong>IPBES<\/strong>:\u00a0<strong>The 7th plenary session of the Intergovernmental Science-Policy Platform on Biodiversity and Ecosystem Services (IPBES) will be held at UNESCO Headquarters in Paris from April 29 to May 4 2019. IPBES<\/strong>\u00a0is an independent intergovernmental body, established by member states in 2012. It provides policymakers with objective scientific assessments about the state of knowledge regarding the planet\u2019s biodiversity, ecosystems and the benefits they provide to people, as well as the tools and methods to protect and sustainably use these vital natural assets.\u00a0<strong>The IPBES Opening\u00a0Ceremony\u00a0will be webcast from\u00a0<a href=\"https:\/\/www.ipbes.net\/webcast-0\">this page<\/a>.\u00a0<\/strong><\/p>\n<p>IPBES has also recorded a series of webinars presenting the\u00a0<strong>key findings of the\u00a0Methodological Assessment of Scenarios and Models and the four Regional Assessments of Biodiversity and Ecosystem Services.<\/strong>\u00a0The webinars are available\u00a0<a href=\"https:\/\/www.ipbes.net\/webinars\">here<\/a>.<\/p>\n<h2><strong>Scientific Community<\/strong><\/h2>\n<p><a id=\"scicommunity\"><\/a><br>\n<strong>Climate<\/strong>:\u00a0Over 3,000 scientists signed on to a\u00a0<a href=\"https:\/\/science.sciencemag.org\/content\/364\/6436\/139.2\">letter<\/a>\u00a0published in Science declaring that youth climate protesters\u2019 concerns are \u201cjustified and supported by the best available science\u201d and \u201ccurrent measures for protecting the climate and biospheres are deeply inadequate.\u201d<\/p>\n<p><strong>NSF<\/strong>:\u00a0<strong>Sen. Chuck Grassley (R-IA)\u00a0<a href=\"https:\/\/www.grassley.senate.gov\/news\/news-releases\/grassley-expands-government-grant-integrity-probe-national-science-foundation\">sent<\/a>\u00a0a letter to National Science Foundation (NSF) Director France Cordova requesting information about foreign influence that may affect NSF funded research.<\/strong>\u00a0The letter inquires about how agency vets researchers receiving NSF funds, how NSF identifies and investigates potential fraud and agency policies to prevent the potential theft of research data and findings. Grassley previously sent similar requests to the National Institutes of Health and the Department of Defense. The Department of Health and Human Services\u2019 inspector general indicated that, after Grassley\u2019s letter to NIH in October 2018, the National Institutes of Health referred 12 cases where NIH-funded researchers failed to disclose foreign ties to the inspector general for further review.<\/p>\n<h2><strong>Federal Register Opportunities<\/strong><\/h2>\n<p><a
