Kerry will be the first person to hold in this position \u2013 he will lead U.S. climate diplomacy efforts. The Biden team has suggested that it will appoint another high-profile individual to lead domestic climate efforts. Kerry\u2019s position does not require Senate confirmation.<\/p>\n<p>Biden nominated Center for American Progress President Neera Tanden to be the White House Office of Management and Budget Director. Among other responsibilities, the Office of Management and Budget (OMB) prepares the annual President\u2019s Budget Request and reviews all new federal regulations through the Office of Information and Regulatory Affairs. Along with the White House Office of Science and Technology Policy, OMB issues a yearly memo to the agency heads outlining research and development budget priorities. Tanden\u2019s confirmation is expected to be contentious, with Senate Republicans already opposing her nomination.<\/p>\n<p>The Public Affairs Office is also continually updating the\u00a0<a href=\"https:\/\/esa.org\/esablog\/federal-agency-nomination-tracker\/\">federal agency transition tracker<\/a>\u00a0as President-elect Biden announces his nominees for positions of interest.<\/p>\n<p>Meanwhile, the incoming administration continues to lay out its plans for the first days of Biden\u2019s term. After the General Services Administration formally recognized Joe Biden as the winner of the 2020 election, Biden\u2019s\u00a0<a href=\"https:\/\/buildbackbetter.gov\/the-transition\/agency-review-teams\/\">transition team<\/a>\u00a0started meeting with agency officials. ESA will share the information with President-elect Biden\u2019s Office of Science Technology and Policy Transition Team.<\/p>\n<p><a href=\"https:\/\/forms.gle\/dfpiEmqPP4bJhTaH9\">View and Complete the Science Policy Recommendation form.<\/a><\/p>\n<p>Be as specific as possible.<\/p>\n<p>Many thanks,<\/p>\n<p>ESA Public Affairs Office<\/p>\n<h2><strong>Congress<\/strong><\/h2>\n<p><a id=\"congress\"><\/a><br>\n<strong>Senate:\u00a0<\/strong>The full Senate\u00a0<a href=\"https:\/\/resource-recycling.com\/plastics\/2020\/12\/02\/federal-lawmakers-pass-save-our-seas-2-0\/\">sent<\/a>\u00a0the Save our Seas 2.0 Act (<a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/senate-bill\/1982\">S. 1982<\/a>) to the president for his signature. This bill creates a Marine Debris Foundation to support NOAA\u2019s marine debris efforts. It encourages partnerships between federal agencies and foreign governments to address marine debris and plastic waste mitigation. The bill\u2019s lead sponsors are Sen. Dan Sullivan (R-AK) and Sen. Sheldon Whitehouse (D-RI).<\/p>\n<p><strong>NDAA:<\/strong>\u00a0A provision in the 2021 National Defense Authorization Act (<a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/6395\">H.R. 6395<\/a>)\u00a0<a href=\"https:\/\/www.sciencemag.org\/news\/2020\/12\/must-pass-us-defense-bill-would-harmonize-funding-disclosures-all-federal-grant\">requires<\/a>\u00a0federal research agencies to ask potential grantees to disclose all sources of current funding for key personnel on grant applications. This requirement comes amid bipartisan concerns about foreign espionage in federally-funded research. Researchers who fail to disclose funding sources could lose their grant funding. The National Defense Authorization Act sets policy for the Defense Department and is considered a \u201cmust pass\u201d bill for Congress. Both chambers of Congress are expected to vote on the bill this week.<\/p>\n<p><strong>House Committees:<\/strong>\u00a0Democratic and Republican Steering Committees nominated new leaders for committees with jurisdiction over environmental policy for the 117<sup>th<\/sup>\u00a0Congress, which begins in January:<\/p>\n<ul>\n<li>Rep. Rosa DeLauro (D-CT)\u00a0<a href=\"https:\/\/www.politico.com\/news\/2020\/12\/03\/house-delauro-appropriations-chair-442601\">will chair<\/a>\u00a0the House Appropriations Committee. DeLauro currently chairs the House Labor, Health and Human Services and Education Subcommittee and is expected to retain that role in the 117th Congress.<\/li>\n<li>Rep. David Scott (D-GA)\u00a0<a href=\"https:\/\/thehill.com\/homenews\/house\/528655-rep-scott-wins-house-agriculture-committee-gavel?gsBNFDNDN=undefined&amp;utm_campaign=wp_the_energy_202&amp;utm_medium=email&amp;utm_source=newsletter&amp;wpisrc=nl_energy202\">will be<\/a>\u00a0the next chair of the House Agriculture Committee. Scott will be the first African American to hold this position. He pledged to focus on addressing racial equities in agriculture and upholding food safety net programs. He replaces Rep. Collin Peterson (D-MN) who lost re-election. Rep. Glenn Thompson (R-PA)\u00a0<a href=\"https:\/\/www.agri-pulse.com\/articles\/14939-thompson-nominated-to-lead-republicans-on-house-ag\">will<\/a>\u00a0lead Republicans on this Committee.<\/li>\n<li>Rep. Cathy McMorris Rodgers (R-WA)\u00a0<a href=\"https:\/\/www.politico.com\/news\/2020\/12\/03\/mcmorris-rodgers-energy-commerce-committee-442526\">will be<\/a>\u00a0the top Republican on the House Energy and Commerce Committee, replacing retiring ranking member Greg Walden (R-OR). Among other responsibilities, the Energy and Commerce Committee has jurisdiction over environmental protection, energy and climate change policy. McMorris Rodgers strongly supports hydropower energy.<\/li>\n<li>Rep. Bruce Westerman (R-AR)\u00a0<a href=\"https:\/\/thehill.com\/policy\/energy-environment\/528422-bruce-westerman-tapped-as-top-republican-on-house-natural-resources\">will be<\/a>\u00a0the ranking member for the House Natural Resources Committee. Current Ranking Member Rob Bishop (R-UT) did not seek re-election this year. Westerman is the lead sponsor of the Trillion Trees Act (<a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/5859\">H.R. 5859<\/a>), which sets a goal of planting a trillion trees by 2050.<\/li>\n<\/ul>\n<p><strong>Legislative Updates:<\/strong><\/p>\n<ul>\n<li>The full House passed the Big Cat Public Safety Act (<a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/1380\">H.R. 1380<\/a>), which bans private ownership and the sale of big cat species, such as tigers, lions, leopards and cheetahs.<\/li>\n<li>Rep. Julia Brownley (D-CA) introduced the Marine Mammal Climate Change Protection Act\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/879\">(H.R. 8795<\/a>), which directs NOAA to develop climate impact management plans for marine mammals.<\/li>\n<\/ul>\n<p>See ESA\u2019s\u00a0<a href=\"https:\/\/esa.org\/esablog\/legislative-tracker\/\">Legislative Tracker<\/a>\u00a0for more updates on legislation relevant to the ecological community.<\/p>\n<h2><strong>Executive Branch<\/strong><\/h2>\n<p><a id=\"executivebranch\"><\/a><br>\n<strong>NSF:\u00a0<\/strong>President Donald Trump appointed Scott Stanley and Matthew Malkan to the National Science Board (NSB). Stanley is a mechanical engineer and a vice president at Techno Planet, Inc., an aerospace company and Malkan is a University of California, Los Angeles astrophysicist. Both will serve six-year terms on the board. The National Science Board is the oversight body for all the National Science Foundation. The NSB also serves as independent science advisors to the President and Congress.<\/p>\n<p><strong>Army Corps of Engineers<\/strong>: The agency\u00a0<a href=\"https:\/\/www.nytimes.com\/2020\/11\/25\/climate\/pebble-mine-permit-denied.html\">denied<\/a>\u00a0a Clean Water Act permit for the proposed Pebble gold and copper mine in Bristol Bay, Alaska. U.S. Army Corps of Engineers Alaska Commander Col. Damon Delarosa said in a statement that the mine is \u201ccontrary to the public interest.\u201d In August 2020, the agency determined that the project \u201ccannot be permitted as proposed\u201d and gave the mining company 90 days to submit a mitigation plan.<\/p>\n<p>These developments are in stark contrast to the Trump administration\u2019s previous approach to the Pebble Mine. In July 2020, the Army Corps of Engineers released a final environmental impact statement for the mine concluding that it would not have a significant impact on the region\u2019s salmon fishery. The Bristol Bay watershed is home to the world\u2019s most productive sockeye salmon fishery. In 2014, the EPA vetoed the mine, citing the impacts of the mine on fisheries. Environmental groups and Alaska Native communities have vehemently opposed the mine for years.<\/p>\n<p><strong>BLM:<\/strong>\u00a0The Interior Department\u00a0<a href=\"https:\/\/www.npr.org\/2020\/12\/03\/942052004\/trump-administration-sets-last-minute-oil-lease-sale-for-arctic-wildlife-refuge\">will hold<\/a>\u00a0a lease auction for drilling in the Arctic National Wildlife Refuge Jan. 6. Industry interest in these leases is low due to the high cost of building infrastructure for drilling, the low oil price and the potential that the Biden administration could block drilling. All major U.S. banks have pledged not to finance development in the refuge. A provision in the 2017 tax bill directs the Bureau of Land Management to hold an oil and gas lease auction for the Arctic National Wildlife Refuge by December 2021.<\/p>\n<p><strong>EPA<\/strong>: The agency\u00a0<a href=\"https:\/\/www.vicksburgpost.com\/2020\/12\/03\/epa-does-not-object-to-proposed-backwater-pumps-project\/\">revived<\/a>\u00a0a long-shelved flood control project along the Mississippi River by overturning a veto of the Yazoo Backwater Area Pumps project. The EPA vetoed this project under the Clean Water Act in 2008, citing the adverse impacts project on 67,000 acres of wetlands and wildlife habitat. Sen. Cindy Hyde-Smith (R-MS) and her predecessor, Sen. Thad Cochran (R-MS), have been pressuring the Trump administration to revisit this decision. American Rivers and other conservation groups will challenge this decision in the courts.<\/p>\n<p>A new\u00a0<a href=\"https:\/\/www.epa.gov\/endangered-species\/draft-national-level-listed-species-biological-evaluation-glyphosate#executive-summary\">draft biological evaluation<\/a>\u00a0for glyphosate\u00a0<a href=\"https:\/\/cen.acs.org\/environment\/pesticides\/Glyphosate-likely-harms-nearly-endangered\/98\/web\/2020\/11?emci=2e0c2014-ce34-eb11-9fb4-00155d43b2cd&amp;emdi=1718fe26-6835-eb11-9fb4-00155d43b2cd&amp;ceid=1236814\">finds<\/a>\u00a0that this herbicide harms nearly all threatened and endangered species. If the EPA\u2019s final evaluation includes the same conclusion, the EPA will have to consult with USFWS and NOAA to develop a plan to protect the affected species.<\/p>\n<p>The EPA celebrated its 50th anniversary earlier this month. An\u00a0<a href=\"https:\/\/www.epa.gov\/50\">EPA website<\/a>\u00a0celebrates the agency\u2019s history and accomplishments over the years.<\/p>\n<p><strong>USFWS:<\/strong>\u00a0The administration\u00a0<a href=\"https:\/\/www.washingtonpost.com\/climate-environment\/2020\/11\/27\/migratory-bird-treaty-act\/\">released<\/a>\u00a0a final environmental impact statement for the agency\u2019s proposed rule codifying a 2017 legal memo declaring that the Migratory Bird Treaty Act only applies to the intentional killing of birds. This environmental impact statement clears the way for the U.S. Fish and Wildlife Service to finalize the proposed rule before the inauguration. Previous administrations have prosecuted and fined companies for violations of the MBTA that harm protected birds. Notably, BP paid a $100 million fine under the Migratory Bird Treaty Act after the Deepwater Horizon spill.<\/p>\n<p>The U.S. Fish and Wildlife Service proposes listing the\u00a0<a href=\"https:\/\/www.theguardian.com\/environment\/2020\/dec\/01\/whitebark-pine-trees-dying-us-west-environment\">whitebark pine<\/a>\u00a0(<em>Pinus albicaulis<\/em>)\u00a0and pepper chub\u00a0(<em>Macrhybopsis tetranema<\/em>)\u00a0under the Endangered Species Act.<\/p>\n<p>Whitebark pine is a tree found in high elevations across the western US and Canada. Most of the tree\u2019s habitat is on U.S. Forest Service lands, with some populations on National Park Service and Bureau of Land Management lands. The tree\u2019s seeds are a key food source for grizzly bears. The agency notes that the species faces four threats: white pine blister rust (an invasive fungus), invasive mountain pine beetle, altered wildfire regimes and climate change. The proposed rule would list the tree as a threatened species under the Endangered Species Act. The\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2020\/12\/02\/2020-25331\/endangered-and-threatened-wildlife-and-plants-threatened-species-status-for-pinus-albicaulis\">rule<\/a>\u00a0is open for public comment through Feb. 1, 2021.<\/p>\n<p>The peppered chub is a freshwater fish historically found in Colorado, Kansas, New Mexico, Oklahoma, and Texas. It is now found only in a small portion of its historical range. USFWS finds that habitat degradation and fragmentation are the primary drivers of the fish\u2019s decline. The agency is accepting\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2020\/12\/01\/2020-25257\/endangered-and-threatened-wildlife-and-plants-endangered-species-status-for-the-peppered-chub-and\">public comments<\/a>\u00a0on this proposed rule through Feb. 1, 2021.<\/p>\n<h2><strong>International<\/strong><\/h2>\n<p><a id=\"international\"><\/a><br>\n<strong>UN:<\/strong>\u00a0The latest World Meteorological Organization State of the Global Climate\u00a0<a href=\"https:\/\/library.wmo.int\/doc_num.php?explnum_id=10444\">report<\/a>\u00a0<a href=\"https:\/\/public.wmo.int\/en\/media\/press-release\/2020-track-be-one-of-three-warmest-years-record\">finds<\/a>\u00a0that 2020 will be one of the three warmest years on record, with the past six years being the six warmest years on record.
