(Courtesy of Rich Camilli, Woods Hole Oceanographic Institution )\" width=\"725\" height=\"506\" srcset=\"https:\/\/esa.org\/esablog\/wp-content\/uploads\/sites\/90\/2012\/10\/sentry-sub-WHOI-deepwater-horizon.jpg 725w, https:\/\/esa.org\/esablog\/wp-content\/uploads\/sites\/90\/2012\/10\/sentry-sub-WHOI-deepwater-horizon-300x209.jpg 300w\" sizes=\"auto, (max-width: 725px) 100vw, 725px\" \/><\/a><\/p>\n<p>This fall has seen the endgame of the US Justice Department\u2019s <a title=\"Attorney General Eric Holder Announces Civil Lawsuit Regarding Deepwater Horizon Oil Spill\" href=\"http:\/\/www.justice.gov\/iso\/opa\/ag\/speeches\/2010\/ag-speech-101215.html\">civil case<\/a> against British Petroleum and eight partners in the matter of the Deepwater Horizon oil well blowout, likely to be settled soon, according to the <em><a title='Daniel Gilbert \"BP Close to Spill Settlement\" 10 Oct 2012' href=\"http:\/\/online.wsj.com\/article\/SB10000872396390444657804578048920996458306.html\">Wall Street Journal<\/a><\/em>. The Justice Department is suing under the Clean Water Act for damages from the 2010 accident, which killed eleven men and spilled a net <a title=\"Testimony to the National Commission on the BP Deepwater Horizon Oil Spill and Offshore Drilling. September 24, 2010\" href=\"http:\/\/www.whoi.edu\/oilinocean\/page.do?pid=52298&amp;tid=282&amp;cid=83528\">4.2 million barrels<\/a> of crude into the Gulf of Mexico, endangering the people, wildlife, and ecosystems of the gulf. The case was <a title='\" BP Oil-Spill Judge Postpones Trial on Fault to February.\" Margaret Cronin Fisk and Allen Johnson Jr., Boomberg - Oct 26, 2012 1:10 PM ET ' href=\"http:\/\/www.bloomberg.com\/news\/2012-10-26\/bp-oil-spill-judge-postpones-trial-on-fault-to-february.html\" target=\"_blank\" rel=\"noopener noreferrer\">scheduled to go to trial<\/a> in January 2013.<\/p>\n<p>In an August memorandum, the JD accused BP of <a title=\"Full text of the 31 Aug memorandum\" href=\"http:\/\/www.scribd.com\/doc\/106482638\/Department-of-Justice-Brief-RE-%E2%80%9CDEEPWATER-HORIZON%E2%80%9D-IN-THE-GULF-OF-MEXICO-ON-APRIL-20-2010\" target=\"_blank\" rel=\"noopener noreferrer\">gross negligence<\/a>. BP could be liable for between $5.4 billion and $21 billion in this case [<span style=\"color: #c93602;\">update to clarify: $21 billion under the Clean Water Act alone; as John Kostyak points out in the comments, the defendants may face further liability under the Oil Pollution Act, among others. Settlement negotiations involve tradeoffs in penalties (it isn\u2019t clear that the OPA fines won\u2019t be levied <a title='\"Now is not the time to work out BP fine money split (Editorial).\" Mike Marshall, Mobile Alabama Press-Register, 15 Oct 2012' href=\"http:\/\/blog.al.com\/press-register-commentary\/2012\/10\/now_is_not_the_time_to_work_ou.html\" target=\"_blank\" rel=\"noopener noreferrer\"><em>instead of<\/em><\/a>, rather than <em>in addition to<\/em>, CWA fines), and as OPA fines count as a <a title='\"Bonner: No tax breaks for BP oil spil fines.\" Mary Orndorff Troyan, Montgomery Advertiser, 1 Nov 2012' href=\"http:\/\/www.montgomeryadvertiser.com\/article\/20121101\/NEWS02\/311010017\/Bonner-No-tax-breaks-BP-oil-spil-fines?odyssey=mod%7Cnewswell%7Ctext%7CFrontpage%7Cs\" target=\"_blank\" rel=\"noopener noreferrer\">tax write-off<\/a>, and CWA monies mostly go to the States, with less stringent requirements that they be applied to environmental remediation, the political pressures are complex. Dare I say, Byzantine? Louisiana is now asking for a <a title='\"Louisiana Seeks Jury Trial on $1 Billion Claim Against BP.\" Laurel Brubaker Calkins, Bloomberg BusinessWeek, on October 25, 2012' href=\"http:\/\/www.businessweek.com\/news\/2012-10-25\/louisiana-seeks-jury-trial-on-1-billion-claim-against-bp\" target=\"_blank\" rel=\"noopener noreferrer\">separate trial<\/a>. The <em>WSJ<\/em> reported that the government is negotiating a combined settlement for criminal penalties. I urge interested readers to click through to the story for details<\/span>], and also faces a <a title='Richard Thompson \"BP settlement administrator urges those affected by oil spill to file claims.\" NOLA 1 Nov 2012' href=\"http:\/\/www.nola.com\/business\/index.ssf\/2012\/11\/opt-out_deadline_in_bp_oil_spi.html\">class action suit<\/a> on behalf of coastal businesses. Its liability <span style=\"color: #c93602;\">under the CWA<\/span> is dependent on the volume of oil spilled (and findings of negligence) \u2013 a number which is, naturally, under dispute.<\/p>\n<p>Scientists from the Woods Hole Oceanographic Institute have found themselves uncomfortably caught up in the legal proceedings after volunteering expert assistance during the emergency. Called upon to help in assessing the failure of the blowout preventer and measuring the rate of oil flow from the broken well, first by BP and later by the US Coast Guard, the scientists have been pushed into taking a side in the case when their findings were seen as unfavorable to the defendants. BP is, in any case, treating them as hostile witnesses.<\/p>\n<p>Last Spring, defense council subpoenaed more than 3000 emails that passed between oceanographers Christopher Reddy, Richard Camilli, and their colleagues during the exploration and data analysis, and in communication with editors and peer reviewers during publication negotiations. The team had already supplied BP with 52,000 pages of data and other materials used to reach their conclusions.<\/p>\n<p>\u201cWhen BP sent its subpoena it stated that it was interested in trying to understand our work better. Then in later filings, they made accusations of misconduct,\u201d Camilli <a title='\"Subpoening Science\" 19 Oct 2012' href=\"http:\/\/www.onthemedia.org\/2012\/oct\/19\/subpoenaeing-science\/\">told NPR\u2019s <em>On the Media<\/em> host<\/a>, Brooke Gladstone. \u201cSo there\u2019s this question of, are they trying to understand, or impugn?\u201d<\/p>\n<p>It seems that they are trying to impugn. The <em><a title='Beth Daley \"Woods Hole Oceanographic Institution researchers call for legal protection for scientists\u2019 private e-mails.\" 28 Sep 2012' href=\"http:\/\/www.bostonglobe.com\/lifestyle\/health-wellness\/2012\/09\/27\/woods-hole-oceanographic-institution-researchers-call-for-legal-protection-for-scientists-private-mails\/KSojKssrxkKCdWSZNL7foO\/story.html\">Boston Globe<\/a><\/em> reported that BP called the WHOI team\u2019s work \u201cfundamentally flawed\u201d and said the researchers made \u201cpuzzling, apparently arbitrary, suspiciously offsetting\u201d choices in their analysis. Because the scientists are not litigants or expert witnesses, they have no opportunity to defend their reputations in court.<\/p>\n<p>A June 14<sup>th<\/sup> <a title='\"Reply to all\" Nature 486, 157 doi:10.1038\/486157a' href=\"http:\/\/www.nature.com\/nature\/journal\/v486\/n7402\/full\/486157a.html\"><em>Nature<\/em> editorial<\/a> warned that scientists \u201cdiscussing their work through written media, including e-mail, should be aware that they could at any time be asked to reveal their conversations.\u201d<\/p>\n<p>This matters, said Camilli, because picking through scientists\u2019 behind-the-scenes conversations for incautious or imprecise statements will force scientists to be\u2014well, cautious, and less candid. Camilli figures that BP is looking for signs that the team disagreed with each other, or changed their conclusions during the course of the investigation. And they could find such evidence, out of context, he says, because as in any scientific investigation, the team argued with each other, played devil\u2019s advocate, and refined their methods. It would be possible to identify contradictions, or times of uncertainty. But this does not mean that they do not stand behind their final report, the authors say.<\/p>\n<p>Furthermore, through the private correspondence the petroleum giant gains access to intellectual property that the scientists would not voluntarily provide, including descriptions of deep sea observation technology and robotic navigation, Reddy and Camilli say.<\/p>\n<p>Camilli and Reddy protested the subpoena in a June 3 <a title=\"Science out of context\" href=\"http:\/\/www.bostonglobe.com\/opinion\/2012\/06\/02\/reddy\/Gt82ZS7yoi5sHTgDG5SLkN\/story.html\">Op-Ed for the <em>Boston Globe<\/em><\/a>, explaining why they think the courts should have probable cause for misconduct before requiring scientists and scientific journals to turn over this type of information. WHOI has made a statement in support of its staff. In September, Jeffrey Seewald, Andy Bowen, and Dana Yoerger joined them in a <a title=\"When Scientific Research and Legal Practice Collide. Science 28 September 2012: Vol. 337 no. 6102 pp. 1608-1609 \" href=\"http:\/\/www.sciencemag.org\/content\/337\/6102\/1608.summary\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Science<\/em> policy forum <\/a>reviewing their experience and others like theirs.<\/p>\n<p>Personal correspondence has been <a title=\"&quot;BP engineer's arrest may force company to reveal internal estimates on Gulf spill.&quot; Suzanne Goldenberg, US environment correspondent, the Guardian, 25 April 2012\" href=\"http:\/\/www.guardian.co.uk\/environment\/2012\/apr\/25\/bp-engineer-arrest-internal-estimates\">subpoenaed by the prosecutor as well<\/a>, including texts from former BP engineer Kurt Max. The texts implied foreknowledge that BP\u2019s attempt to cap the well would fail at the estimated flow rate. BP has attempted to withhold its own internal estimates. Max has been charged with destroying evidence.
